Usually, the local authority’s social services or the Court of Protection Panel will refer a new case to us. Often this will be someone who has been moved into care, and they have no close family to provide any background or financial history. Court of Protection cases often require swift and thorough investigation to establish the financial position of vulnerable individuals, ensuring that their ongoing care needs are met without delay.
As a result, it is important to ascertain as much information as possible from the outset. In some cases, the Court will issue an Interim Order to investigate a person’s financial situation with the aim of confirming whether they have sufficient funds to support their ongoing care and financial needs.
Where a Deputy has been appointed but the protected party passes away, the Deputy’s authority ends immediately and unable to undertake any further work on behalf of that person. Therefore, as well as establishing the assets within an estate for care provision, it is also important that we complete a Will Search at the earliest opportunity. By locating the Will this allows the Deputy to confirm who should be contacted upon death but also confirms who will inherit those assets when the person dies.
For many court of protection cases, identifying and protecting the financial assets of vulnerable individuals is a crucial part of ensuring that their affairs are handled properly.
